COMMISSION TERM OF SERVICE
✦ General1. I reserve the right to decline any commission orders without any explanation.2. I may decline an order if the project and/or character are something we cannot deliver well. Read do's & don'ts below.3. I strongly do not accept commissions with hardcore R-18 content and offensive themes.4. You will only receive full resolution digital file/s of the commission. No physical item will be shipped to your home address.5. Only participate in any transaction with me if you are over the age of 18, and are able to pay of your own ability (have your own PayPal account, credit card, etc.).✦ Uses and Credits1. Do not use the artwork for commercial use unless discussed beforehand. There are extra charges and/or royalties involved for commercial projects.2. Do not claim full credit to the artwork's creation even if you have ownership of the artwork.3. I retain rights to artist credits and publishing the art in our personal portfolio & social media.4. Publishing and privatization of commissions can be considered and discussed, especially for marketing purposes of commercial work.5. Reposting your commissioned artwork is allowed as long as proper crediting is given (such as linking any of the artist's relevant social media account/s).6. Noncommercial and commercial works made by KemBo_chan are NOT authorized for use in any blockchain-related technology including NFTs and any form of cryptocurrency.✦ Payments, Refunds, and Cancellations1. The commission will only be official and started after the upfront payment has been made.2. I, as the artist, reserve the right to refund and cancel the commission at any time.3. Please do not make chargebacks. You may request a refund and cancel the commission only if we take more than 1 month without progress.4. In the event of a full refund or chargeback, you will forfeit your ownership and rights to the commissioned artwork/s at any stage of progress.5. Partial refunds will be considered if the commission has been started, and you are allowed to keep the commission files sent.6. Any additional charges (rush fees, further edits, added assets, etc.) will be upheld and respected by all parties involved.✦ Requests and Revisions1. Changing references is allowed if I haven't started on your commission. Please ask first if I started or not!2. I will provide screenshots of WIPs throughout the process. You are limited to 3 edit sessions during sketching stage, and 1 chance for minor adjustments in the finishing stages (including hues, painting in missing details, etc.).3. Any further edits will have added fees to the overall cost.4. No major changes are allowed in the finishing stage that will affect the overall composition of the artwork.

ADOPT TERM OF SERVICE
✦ADOPTABLE PAYMENT + PLANS1. Payment is taken in USD. This will be through paypal invoice or stripe via credit card.2. Please check with me before end time if needing a payment plan.
Payment should be within 24 hours, but it can be negotiated. I am comfortable if communication is clear.3. I can negotiate payment plans over $200 with $100 down. This must be cleared with me before purchase is confirmed. Timeframe of payment plans should be 4 weeks maximum.4. If you have outstanding payments with me you cannot make any further purchases until it is cleared.5. You will not receive the fullfiles until the full balance is paid.✦ OWNING A DESIGN1. When you have purchased a character from me, they belong to you. You may use them for whatever you wish, such as for RP purposes.2. There is no set history or personality, and you do not have to use my canons for specific closed species. It is a personal preference that if a character is gendered female by me, it is presented that way in trades/reselling.3. Trading and gifting are both permitted.4. If you would like to hide the amount you paid for the adoptable in my deviation comments, inform me and I can do so.5. I still retain the right to post and use art I have drawn (your ownership will be credited if necessary).✦ RESELLING - MONETARY TRANSACTION1. Reselling is permitted but please let me know2. You must have owned the design for at least 4 weeks/1 month before you can resell it.3. You are only eligible to resell the adoptable if you are the ORIGINAL OWNER, or paid for it via sale. The design must be fully paid for.
You must have the un-edited, full file of the adopt in order to resell it.
You cannot sell it for more than what you paid, but may add the cost of commissioned art. Please mention the base price of the design to buy it as-is without extras.
You cannot resell an adoptable obtained via trade, gift or other means.4. If the design was obtained in an OTA it can only be sold for the monetary offer, and not the worth of any additional design/art it was obtained for.✦OFFENSES THAT WILL RECEIVE A WARNING1. Claiming the art or design as your own, unless your design was a MYO2. Asking for a refund3. Withdrawing your bids, or hiding bids to withdraw them.4. Reposting my artwork without permission, or repost original art without watermarking5. Traded and gifted designs cannot be resold
